Is a digitally signed lease agreement legally valid?

Yes. Lease agreements can be entered into electronically; Paperless supports all eIDAS signature levels. For documents required by law to be in writing, the qualified electronic signature (QES) provides the legal equivalent of a handwritten signature. Only notarization, such as for a real estate purchase agreement, must still be performed by a notary.

What signature level do I need for which document?

As a rule of thumb: SES for informal confirmations, AES for day-to-day business (brokerage agreements, property handover reports), QES wherever written form is required or the risk is high, and the qualified seal for mass mailings on behalf of the organization. If you’re unsure, we’ll advise you on the appropriate level.

How are tenants and buyers identified (keyword: GwG)?

Directly during the signature process, via eID, AutoIdent, or VideoIdent through the three major German identity providers: Nect, IDnow, and WebID. About 30 million Germans have already been verified through these providers; for them, the identity verification step is skipped.

What happens to sensitive data such as self-disclosure forms?

All data is hosted exclusively in Germany—in compliance with the GDPR, using German subcontractors, and not subject to the U.S. CLOUD Act. With an API connection, your documents even remain entirely within your own system: only the cryptographic hash is signed.
